This document is an electronic record in terms of the Information Technology Act, 2000 and published in accordance with the provisions of Rule 3 of the Information Technology (Intermediaries Guidelines) Rules, 2011 that require publishing the rules and regulations, privacy policy, and Terms of Use for access or usage of the Trend Shopy marketplace platform – www.trendshopy.in

The Platform is owned by trendshopy.in, having its registered office at Trend shopy Door no 585 Ernakulam Kerala 683516 .

Your use of Trend Shopy and its services and tools are governed by the following terms and conditions ("Terms of Use") as applicable to Trend Shopy, including the applicable policies which are incorporated herein by way of reference. By mere use of Trend Shoppy, You shall be contracting with Trend Shopy, the owner of the Platform. These terms and conditions, including the policies, constitute Your binding obligations with Trend Shopy.

For the purpose of these Terms of Use, wherever the context so requires, "You" or "User" shall mean any natural or legal person who has agreed to become a buyer on the Platform by providing data while registering on the Platform as a Registered User. The term "Trend Shopy", "We", "Us", "Our" shall mean Trend Shopy Private Limited and its affiliates.

When You use any of the services provided by Us through the Platform, including but not limited to (e.g., Product Reviews, Seller Reviews), You will be subject to the rules, guidelines, policies, terms, and conditions applicable to such service, and they shall be deemed to be incorporated into this Terms of Use and shall be considered as part and parcel of this Terms of Use. We reserve the right, at Our sole discretion, to change, modify, add, or remove portions of these Terms of Use at any time without any prior written notice to You. You shall ensure to review these Terms of Use periodically for updates/changes. Your continued use of the Platform following the posting of changes will mean that You accept and agree to the revisions. As long as You comply with these Terms of Use, We grant You a personal, non-exclusive, non-transferable, limited privilege to enter and use the Platform. By impliedly or expressly accepting these Terms of Use, You also accept and agree to be bound by Trend Shopy Policies including but not limited to the Privacy Policy as amended from time to time.

1. User Account, Password, and Security:

If You use the Platform, You shall be responsible for maintaining the confidentiality of your Display Name and Password and You shall be responsible for all activities that occur under your Display Name and Password. You agree that if You provide any information that is untrue, inaccurate, not current, or incomplete, We shall have the right to indefinitely suspend or terminate or block access to your membership on the Platform.

You agree to immediately notify Trend Shopy of any unauthorized use / breach of your password or account and ensure that you exit from your account at the end of each session.

2. Services Offered:

Trend Shopy provides a number of Internet-based services through the Platform. One such Service enables Users to purchase original merchandise such as clothing, footwear, and accessories from various fashion and lifestyle brands (collectively, "Products"). The Products can be purchased through the Platform through various methods of payment offered. The sale/purchase of Products shall be additionally governed by specific policies of sale, like the cancellation policy, exchange policy, return policy, etc. (which are found on the FAQ tab on the Platform and all of which are incorporated here by reference).

It is clarified that at the time of creating a return request, users are required to confirm (via a check box click) that the product being returned is unused and has the original tags intact. If the product returned by the user is used, damaged, or if the original tags are missing, the user’s return request shall be declined, and the said product shall be re-shipped back to the customer. In such case, the user shall not be eligible for a refund, and Trend Shopy assumes no liability in this regard. If the user fails to accept the re-shipped product, they shall still not be eligible for a refund, and Trend Shopy will not be responsible for return or refund of such product.

In addition, these Terms of Use may be further supplemented by Product-specific conditions, which may be displayed with that Product.

Trend Shopy does not warrant that Product descriptions or other content on the Platform are accurate, complete, reliable, current, or error-free and assumes no liability in this regard.

3. Platform for Transaction and Communication:

The Users utilize the Platform to meet and interact with one another for their transactions. Trend Shopy is not and cannot be a party to or control in any manner any transaction between the Users.

• All commercial/contractual terms are offered by and agreed to between Buyers and Sellers alone. Trend Shopy does not determine or control those terms.
• Trend Shopy makes no representation or warranty as to the quality, value, salability, etc., of the products/services listed.
• Trend Shopy is not responsible for non-performance or breach of any contract between Buyers and Sellers.
• At no time shall Trend Shopy have any right, title, or interest in any products sold nor shall it have any obligations or liabilities in such contracts.
• Trend Shopy only provides a platform for communication and facilitation. The contract for sale is strictly between the Buyer and Seller.
• Any pricing errors due to typographical issues or data input from Sellers may lead to order cancellations by Sellers.

You release and indemnify Trend Shopy, its officers, and representatives from any liability arising out of user actions. Despite reasonable efforts, Trend Shopy cannot ensure or control the information provided by other Users on the Platform.

4. User Conduct and Rules on the Platform:

You agree, undertake and confirm that Your use of the Platform shall be strictly governed by binding principles, including that You shall not:

• Post or share content that belongs to someone else or violates their privacy or intellectual property rights.
• Host or share unlawful, obscene, abusive, or fraudulent content.
• Involve in spamming, phishing, or spreading malware.
• Interfere with other users’ experience or violate any local, state, national, or international laws.
• Submit incorrect details during registration or place fake/bulk/fraudulent orders.
• Return wrong or used products while claiming returns/refunds.

Trend Shopy reserves the right to cancel such suspicious or fraudulent orders and may classify orders as bulk/fraud orders if:

• The products are meant for resale.
• Multiple orders are placed for the same item.
• The shipping address is invalid.
• Any malpractice is identified.

Trend Shopy does not support B2B transactions or input tax credit claims and advises users not to use the platform for such purposes.

You shall not use the Platform for unlawful purposes or in ways that cause harm to the Platform, its users, or its policies.
